1. Acceptance of the Terms
1.1. These Terms of Use (“Terms”) govern your access to and use of the website located at https://www.octobotics.tech/ and any pages or content under the domain (collectively, the “Site”).
1.2. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy referenced here. If you do not agree, you must not access or use the Site.

2. About Octobotics Tech
2.1. The Site is owned and operated by Octobotics Tech Pvt. Ltd. (“Octobotics”, “we”, “us”, “our”), a company incorporated under the laws of India.
2.2. We design, assemble, test and dispatch our equipment in-house while engaging contracted vendors for component manufacturing; and we offer robotic/autonomous non-destructive testing (NDT) solutions and services across multiple industrial sectors.

3. Eligibility and Use of the Site
3.1. You must be capable of entering into a legally binding contract under Indian law to use the Site.
3.2. You agree to use the Site only for lawful purposes and in accordance with these Terms.
3.3. You must not:
a) interfere with or disrupt the Site or servers or networks connected to the Site;
b) introduce any viruses, worms or other malicious or harmful code;
c) violate any applicable law or regulation;
d) attempt to gain unauthorised access to any portion or feature of the Site;
e) engage in data scraping, harvesting, or automated data extraction without our prior written consent;
f) impersonate any person or entity or misrepresent your affiliation with any person or entity;
g) use the Site in a manner that infringes intellectual property or privacy rights of any third party;
h) use the Site for advertising or solicitation without written permission.

4.1. The Site may provide general corporate, product, and service information, technical overviews, articles and other content for information purposes only. Such content does not constitute advice (including engineering, safety, legal, tax or other professional advice).
4.2. While we endeavour to keep information accurate and up to date, we do not warrant completeness, reliability, or timeliness. We may modify, update, suspend or discontinue the Site (or any part) at any time without notice.

5.2. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site and the Content for your personal, non-commercial use.
5.3. Except as expressly permitted, you must not copy, reproduce, republish, upload, post, transmit, modify, create derivative works of, publicly display, sell, or distribute the Content without our prior written approval.
5.4. Our company names, logos, product names and trade dress are trademarks/service marks of Octobotics. Other names and marks may be trademarks of their respective owners. No rights are granted to use any trademarks without our written permission.

6. User Submissions and Feedback
6.1. If you submit inquiries, messages, feedback, testimonials, suggestions, files, or content through forms or email (“Submissions”), you grant Octobotics a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute and display such Submissions for the purposes of operating, improving and promoting the Site and our business, subject to applicable privacy laws.
6.2. You represent and warrant that your Submissions do not infringe any third-party rights and do not contain unlawful or harmful material.
6.3. We may remove any Submissions that violate these Terms or applicable law.

7.1. The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Octobotics. We do not endorse or assume responsibility for any third-party sites or services. Your use of third-party sites is at your own risk and subject to their terms and policies.
7.2. Some Site functionality may be provided via third parties (e.g., hosting, analytics, forms, video, social embeds). Their processing of personal data is governed by our Privacy Policy and their own policies.

8. No Warranties
8.1. THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
8.2. We do not warrant that the Site will be error-free, timely, secure, or uninterrupted, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OCTOBOTICS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.
9.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED INR 10,000.
9.3. NOTHING IN THESE TERMS LIMITS LIABILITY WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

10. Indemnity
10.1. You agree to indemnify, defend, and hold harmless Octobotics and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your misuse of the Site.

11. Suspension and Termination
11.1. We may suspend or terminate your access to the Site at our sole discretion, with or without notice, if we reasonably believe you have violated these Terms or applicable law.
11.2. Upon termination, all rights granted to you under these Terms will cease immediately.

12. Compliance
12.1. You agree to comply with all applicable laws, including export control, sanctions, and anti-corruption laws, in connection with your use of the Site.
12.2. You shall not use the Site in jurisdictions where such use is restricted by law.

13. Force Majeure
13.1. We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, war, terrorism, labour disputes, power failures, internet failures, outages, or restrictions of government authorities.

14. Governing Law and Dispute Resolution
14.1. These Terms are governed by and construed in accordance with the laws of India.
14.2. Subject to applicable law, the courts at Noida, Uttar Pradesh, India shall have exclusive jurisdiction over disputes arising from these Terms or your use of the Site.
14.3. Where permitted by law, the parties may agree to resolve disputes by arbitration in New Delhi under the Arbitration and Conciliation Act, 1996. The language will be English and the seat New Delhi.

15.1. We may revise these Terms at any time. The “Last Updated” date indicates the latest changes. Your continued use after posting changes constitutes acceptance.
